「次なる法律」「就労外国人の日本語教育も」日本語議連の里見事務局次長が日本語学校ネットワークで講演

日本語教育推進議員連盟の里見隆治事務局次長（公明党参院議員）が6月29日、東京都内で開いた日本語学校ネットワークの勉強会に招かれ、「日本語教育推進基本法（仮称）制定に向けて」と題して講演した。先に基本法の原案（政策要綱）が明らかにされたが、条文化の作業と併せて内容の点検が行われている。基本法の中で「検討事項」として位置づけられる日本語学校の制度整備について里見氏は、基本法制定後に「国の宿題」となるほか、日本語議連としても必要であれば「次なる法律」を検討することになる、との見方を示した。
里見氏は厚生労働省出身。職業安定局外国人雇用対策課企画官やＥＰＡ受入対策室長を歴任するなど、政界では外国人の雇用、労働のトップレベルの専門家。日本語議連では事務局次長として馳浩事務局長を支えてきたほか、立法チーム（4人）の一員として基本法の原案づくりに携わった。
講演で里見氏はネットワークの会員約50人を前に、まず基本法の原案のポイントとなる条項を説明。この中で基本法が国や地方自治体に対し日本語教育推進の「責務を有する」として責任を明確にするとともに、外国人を雇用する企業には国の施策への「協力」と日本語学習への「支援」を規定していることを指摘し、就労外国人への日本語教育が日本語学校の新たなビジネスになる可能性を示唆した。
また質疑の中で議論の焦点となったのが、基本法原案の中のワーディング。「学校」「日本語教育機関」「評価」などの言葉は、どのように概念を規定するかによって法文の意味合いが変わってくる。それだけ日本語教育の法整備は難しいということだが、日本語議連にはすでに様々な意見が寄せられているという。
「学校」については、第一章の総則の「関係者相互間の連携強化」の項で「学校（学校教育法第一条に規定する学校を言う。以下同じ）、日本語教育を行う機関、外国人等を雇用する機関……」とあるが、法務省告示の日本語学校の中には、学校法人の専門学校と各種学校、学校法人ではない株式会社立の学校など様々な設置形態があり、学校を「一条校だけ」と規定するのはおかしいのでは、との声が出ているという。里見氏は「学校を狭くとらえる必要はないと思う。法律上はなるべく広くしていきたい」と述べた。
「日本語教育機関」については、第三章の基本的施策の「日本語教育機関関係」の項で「国は日本語教育を行う機関の教育水準の維持向上を図るため、必要な措置を講ずるものとすること」とある。ここで言う「日本語教育機関」とは、まさに「日本語教育を行う機関」なのだが、法務省告示の日本語学校だけではなく幅広く考えることが必要だという。しかし、教育の質を担保するためには一定の教育レベルでの線引きが必要だ。里見氏は「いわゆる学習塾的なところまで入るかどうか。その辺はグレーになる」と話した。現時点では解釈が明確になっていないということだ。
そうした事情があったからこそ、日本語学校に関する法的な整備が「検討条項」として扱われたわけだ。第五章その他の「検討」の項目には「国は、次に掲げる事項その他日本語教育機関について検討を加え、その結果に基づいて必要な措置を講ずるものとすること」とあり、学校の類型化など4点の検討項目を挙げている。
日本語学校はグローバル人材育成の重要な役割を担っているにもかかわらず、その制度の整備があいまいにされてきた。今回、そのツケが回ってきたとも言える。そうした中で、日本語学校は4年前に比べて約200校増え、今年6月8日現在で680校に達している。学校によっては就業目的の外国人を受け入れているケースもあり、日本語学校の在り方が問われている。
また、日本語学校の業界団体が複数あり、業界としてのコンセンサスづくりが難しいのが現状だ。基本法が成立したら、政府は日本語教育に従事する有識者で構成する「日本語教育専門家会議」を発足させる。その委員として日本語学校業界から誰を呼ぶのか。日本語学校に関する議論がまとまるのかどうか。政府関係者の間から、業界の「不協和音」を懸念する声が出ている。
